Terms of Service
Effective: April 17, 2026 · Somang Society · California, USA
1. Agreement to these terms
By accessing or using Somang Society websites, event pages, or related online services (collectively, the “Services”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.
2. Who may use the Services
The Services are intended for users who can lawfully enter into contracts in California. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. Certain features (such as donations) may have additional terms presented at the time of transaction on our third-party payment or donation pages.
3. Permitted use
You agree not to:
- Use the Services in violation of applicable law, including California and federal law.
- Attempt to gain unauthorized access to our systems, other users’ information, or any networks or data connected to the Services.
- Interfere with or disrupt the integrity or performance of the Services, including by transmitting malware or harmful code.
- Scrape, harvest, or automate access to the Services in a way that impairs site operation or exceeds reasonable personal use, except as allowed by robots.txt or written permission.
4. Donations, RSVPs, and third-party services
Donations may be processed through our donation platform; those transactions are also governed by the terms and privacy notices of that provider. RSVP or registration information may be collected through tools we operate (such as Google Forms). Your use of third-party sites linked from our Services is at your own risk and subject to those third parties’ terms.
5. Intellectual property
Text, graphics, logos, event names, and other content on the Services are owned by Somang Society or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for reasonable personal sharing that credits Somang Society and does not imply endorsement where none exists.
6. Disclaimers (California)
To the fullest extent permitted by the laws of the State of California, the Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers; in those cases, our disclaimers apply to the maximum extent allowed.
7. Limitation of liability
To the maximum extent permitted by California law, Somang Society and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any unauthorized access to or use of our servers or personal information; or (c) any other matter relating to the Services. Our aggregate liability for claims arising out of or relating to the Services shall not exceed the greater of one hundred U.S. dollars (USD $100) or the amount you paid us (if any) for the specific service giving rise to the claim during the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
8. Indemnity
You agree to defend, indemnify, and hold harmless Somang Society and its personnel from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms, to the extent permitted by California law.
9. Governing law & venue (California)
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules that would require the application of another jurisdiction’s laws. For any dispute not subject to mandatory arbitration or small-claims procedures, you and Somang Society agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California, except that either party may seek injunctive relief in any court of competent jurisdiction.
10. California consumers
California residents: please see our Privacy Policy for information about personal information practices and your rights under the CCPA/CPRA, including how to contact us.
11. Changes; severability
We may modify these Terms at any time by posting an updated version on this page and updating the effective date. Continued use after changes constitutes acceptance. If any provision is held invalid or unenforceable under California law, the remaining provisions remain in effect.
